US District Courts

The United States District Courts

Taxpayers may elect to have their tax law matter litigated before the United States district court. The district courts are the trial courts of the United States federal court system. Any case or cause of action based on federal law can be brought in a U.S. district court. District courts are popular because they offer litigants an opportunity to try their case before a jury.

The attorneys at Thorn Law Group are committed to helping clients successfully resolve their tax controversies and have developed a record of achievement for litigating tax law matters throughout the federal court system.

District Court Litigation

Litigation in the district courts can be brought against private parties or against the U.S. government. The district courts hear civil cases and prosecutions for alleged violations of federal crimes.

Cases are generally tried in the district where the activity at issue occurred or where the parties reside or have a principal place of business. Appeal of a decision by a district court must be made to the Circuit Court of Appeals for the Circuit where the district court lies. Thus, the district court must follow the rulings of the Circuit Court of Appeal for the circuit in which the district court lies.

Trials and pre-trial activities are governed by the Federal Rules of Civil Procedure and the Federal Rules of Evidence. In cases where the U.S. government is a party to the litigation, the government is represented by attorneys from the Department of Justice or the Office of the United States Attorney for the district the court is located in.
